Confirmation of Brand Name Coverage During Generic Drug Shortage per Public Act 103-0758

This notice confirms to pharmacies that the Department of Healthcare and Family Services (HFS) is in compliance with Public Act 103-0758 regarding generic drug shortages. 

It has been HFS’ policy that, if a generic drug or a therapeutic equivalent is unavailable due to a supply issue, as identified by either the Food and Drug Administration (FDA) or the American Society of Health-System Pharmacists (ASHP), and the dosage cannot be adjusted, the Department will cover a brand name eligible prescription drug until supply of the generic drug or therapeutic equivalent is available.
