​Re: Reminder of Pharmacy Signature Requirements Resumption 

The purpose of this notice is to remind providers of requirements related to pharmacy signature logs.

The Payment Error Rate Measurement (PERM) program, under the federal Department of Health and Human Services, Centers for Medicare & Medicaid Services (CMS), measures  improper payments within each state's Medicaid Program and Children’s Health Insurance Program (CHIP). The Reporting Year 2019 PERM audit resulted in the identification of errors related to pharmacy signature log requirements. However, pursuant to COVID-19 Disaster State Plan Amendment (SPA) flexibilities, HFS temporarily ceased pharmacy signature log requirements during the Public Health Emergency (PHE).

By previous provider notice, HFS confirmed that signature log requirements would resume effective with dates of service on and after May 12, 2023, with the same requirements that were in place prior to the PHE.

Providers are reminded that signatures must be able to be reproduced and provided upon request during an audit inquiry. Signature requirements are identified in 89 Ill. Admin Code section 140.450.

Recoupments may be made for items where no signature was received, or where the receipt of the signature cannot be provided.
