This notice serves as reminder that long-term care (LTC) nursing facility providers that have not fully repaid outstanding advance payments, as well as any other LTC nursing facility provider that holds an advance payment agreement with HFS, have the opportunity to enter into a renegotiated payment agreement by August 15, 2026. Beginning September 1, 2026, HFS is required to immediately recoup outstanding unpaid advances if a renegotiated advance payment agreement is not in place.
Pursuant to Public Act 104-0470, LTC nursing facility providers must enter into a renegotiated advance payment agreement with the Department of Healthcare and Family Services (HFS) no later than 60 days after the effective date of Public Act 104-0470; therefore, renegotiated advance payment agreements must be in place no later than August 15, 2026.
LTC nursing facility providers should refer to the Provider Notice issued in July 2026 for additional information on the renegotiation, repayment, and recoupment processes.
The new template for the renegotiated advance payment agreement has been emailed to the contact on file with the HFS Bureau of Long Term Care. LTC nursing facility providers that have not already entered into the renegotiated advance payment agreements should sign, date, and return the agreement to HFS.LTCAdvances@Illinois.gov for HFS signature as soon as possible, and no later than Friday, August 14, 2026, close of business. Signed copies of the agreement will then be returned to the sender via email from HFS.LTCAdvances@Illinois.gov.
