This Notice informs Nursing Facility (NF) IMDs of provisions of the Specialized Mental Health Rehabilitation Act of 2013 which provides for a new category of licensure for long term care facilities that are federally designated as IMDs. As of July 22, 2013, NF-IMDs shall be governed by this Act instead of the Nursing Home Care Act. In addition, all consent decrees that apply to NF-IMDs shall continue to apply to facilities licensed under this Act.
Effective July 22, 2013, NF-IMDs must become provisionally licensed through the Department of Public Health as Specialized Mental Health Rehabilitation Facilities (SMHRFs). The Department of Public Health will establish provisional licensure and licensing procedures, by emergency rule, within 120 days of the effective date of the Act. Certification as a Medicaid provider through the Department of Healthcare and Family Services will change from Provider Type 33 (Nursing Facility) to a Provider Type 38 (NF-IMD).
Per diem rates will be frozen at the level in effect June 30, 2013, minus $7.07. NF-IMDs, which are currently paying the $6.07 Provider Assessment amount for each occupied bed and $1.50 for each licensed bed, will be mailed revised fiscal year 2014 assessment notices prorating the assessments for July 1, 2013 through July 21, 2013. Effective July 22, 2013, the NF-IMDs will no longer be subject to the Long Term Care Provider Assessments.
