On September 21, 2011, an initial memorandum was sent to you referring to the United States District Court ruling in Colbert v. Quinn, No. 07 C 4737 (N.D. III) stating that nursing facility residents must have an opportunity to receive the full array of supports and services they need in the most integrated settings appropriate to their needs, including community-based settings.
The Court subsequently found on December 21, 2011, the Consent Decree to be a fair, reasonable and adequate resolution of this class action litigation. An implementation plan is in the process of development and the Court has appointed a monitor, Dennis Jones, MSW, MBA to examine this process. The implementation plan is to be submitted by the Illinois Department of Healthcare and Family Services (HFS) on June 21, 2012, with Court approval planned by September 20, 2012. Subsequent to its approval, the process of engaging nursing home residents regarding the Colbert Decree will begin.
As part of the planning and implementation process, Mr. Jones will commence visiting a number of nursing facilities in Cook County beginning in April 2012. Mr. Jones may be contacting your facility in the near future to conduct a site visit. He will likely be accompanied by one of our staff. In preparation for this visit, Mr. Jones will indicate his desire to meet with staff and residents. Please facilitate his access. HFS appreciates your cooperation in this court mandated effort.
