This notice is to inform Supportive Living Program (SLP) providers that SLPs operate under the federal 1915(c) Home and Community-Based Services (HCBS) Medicaid Waiver program. As such, SLP is subject to numerous HCBS federal requirements, one of them being provider setting requirements. The intent of the HCBS Settings regulations is to ensure that individuals receiving long-term services and supports have full access to the benefits of community living and the opportunity to receive services in the most integrated setting appropriate to their needs.

Federal Centers for Medicare & Medicaid Services (CMS) requires HCBS provider settings be integrated into and support full engagement within the broader community as well as facilitate meaningful interaction, participation, and choice for residents. The intent of the HCBS settings requirements is to promote independence, engagement, and inclusion. All SLP setting practices must reflect these principles.

The Department of Healthcare and Family Services (HFS) previously provided guidance and training on the CMS HCBS settings requirements below.

This provider notice addresses the two (2) HCBS settings requirements outlined below.

  1. Individuals have the right to control their own income and resources. This includes determining whether to use a representative payee, selecting a representative payee of their choice, and deciding how to use their personal needs allowance (PNA).
  2. Individuals have the right to seek employment and work in competitive integrated settings.

Both of the above settings requirements are required under eCFR: 42 CFR 441.301 -- Contents of request for a waiver.

The SLP needs to support individuals in both controlling their own income and resources (e.g., access to individual bank accounts, support in accessing resources), and their right to seek employment and work in competitive integrated settings.

Below are two tables that outline the two settings requirements and the corresponding implementation steps.

CMS HCBS Settings Requirement: All individual residents continue to be educated on their right to control their own money and, if assigned to a rep payee, choose a rep payee of their choice and use their PNA as they wish.

SLP Community Settings Requirement:

How to Implement and Meet the Requirements:

SLP staff cannot force incoming residents to assign the SLP provider as a rep payee.

  • Create staff training to address requirements. More details discussed below regarding training requirements.

Ensure Residents understand what the personal needs allowance (PNA) is and how it is deducted.

 

 

 

  • Ensure the lease agreement language reflects requirement.
  • Include a section that educates and informs residents of the PNA and residents’ income and resources.
  • New residents sign the lease agreement upon moving in. All other residents will sign new updates annually.
  • Educate each resident on their right to control their own income, resources and the PNA.
  • Once educated, the residents will sign an acknowledgement stating that they have been informed and educated.
  • The form is kept in the resident's chart. The resident/ POA may have a copy anytime when requested
  • Create a new policy and procedures regarding the PNA and Resident’s right to control their own income and resources
  • Create a handout/brochure providing information on residents’ rights to control their own income and resources and use their PNA as they wish.
  • Brochures/handouts must be given to all residents and their POAs at initial admission and annually.  The resident/ POA may have a copy at any time once requested.
  • The brochure/handout will be hung in multiple areas of the SLP.
  • Create/update an admissions checklist to include language about education of the PNA, resident’s right to control their own income and resources, and the patient liability calculation.

Topics discussed annually in resident council meetings, with logs of attendees and topics presented.

  • Add an annual requirement to discuss resident’s right to control their own income/resources, use their PNA as they wish and designate a rep payee in a monthly resident’s meeting.
  • Residents who attend the meeting will sign a sign-in sheet. Agenda and meeting minutes will be provided. The residents will be informed prior to meeting of when information/ education will be provided regarding PNA and residents’ income and resources.
  • The residents will be informed of the agenda at least 7 days prior to the meeting by flyers and mail.

The SLP will meet with each individual resident to educate them on their rights to control their own income, resources and PNA.

  • The SLP must meet with each individual resident to educate/ inform them of their PNA and resident's right to control their own income and resources.

The SLP will document individual resident preferences

  • The SLP must document the preferences in each Medicaid residents ISP.
  • The ISP template must be updated to include questions and residents’ needs and preferences.

Update SLP Procedures and Policies

  • Create a policy/procedure outlining all new requirements and who is responsible.
  • Staff training
  • Annually discussed in resident council meetings
  • Providing handouts/brochures to residents annually and with any new admission.
  • Meeting with residents and updating ISP

Staff Training

  • Create staff training regarding residents' right to control their own income and resources, choose a rep payee of their choice and use the PNA as they wish.
  • After completion, staff should sign acknowledgment form.
  • Training on these topics is required for all new hires, as well as through ongoing annual training for all employees

CMS HCBS Settings Requirement: The SLP must support individuals in creating opportunities to seek employment and work in competitive integrated settings.

 

SLP Settings Requirements:

How to implement and meet the requirement

Provide information and opportunities related to employment and volunteering in the community.

 
  • Install a “job/volunteer” informational bulletin board in a common area in the SLP that has employment and volunteer opportunities in the community.  The board should be updated monthly.

 

 




Create and maintain a referral process.

  • Create a referral process for employment and volunteer opportunities in the community.
  • Assign a staff member to assist with the employment and volunteer referral process alongside the resident. All information will be reviewed monthly during the resident meeting.
  • Hold monthly resident meetings addressing resident rights and other agenda items.

Topic discussed annually in resident council meetings, with logs of attendees and topics presented.

  • Add an annual requirement to discuss residents’ rights to pursue competitive employment and/or volunteer opportunities, including participation in competitive integrated settings, during a monthly resident council meeting.
  • Residents who attend the meeting will sign a sign-in sheet. Agenda and meeting minutes will be provided. The residents will be informed prior to meeting of when information/ education will be provided regarding this topic. 
  • The residents will be informed of the agenda at least 7 days prior to the meeting by flyers and mail.

Require SLP individualized engagement with residents on their interest in opportunities for volunteer work or paid employment and documentation of individual goals and resources provided.

  • Meet with each resident to discuss their interest in opportunities for volunteer work or paid employment.
  • Provide resources regarding volunteer and employment opportunities, if residents are interested.
  • Document resident goals and interests in the resident record.

The SLP will update the ISPs to include questions asking if the resident wants to seek employment or volunteer on current residents and make the questions part of new admission ISPs moving forward. If the individual expresses interest in employment or volunteer opportunities, the ISP will include a plan to pursue such opportunities and work in competitive, integrated settings.  The SLP will also update the ISS with the same questions and follow-up to be forwarded to the MCOs to complete

  • Document resident goals and interests in the resident record
  • Update the ISP to reflect the resident’s preferences, interests and goals. If the resident is on an MCO, the SLP will forward the updated ISP/ISS to the MCO.

Staff Training

  • New training will be created to address this requireme.
  • Training on these topics is required for all new hires, as well as through ongoing annual training for all employees.

Update SLP Procedures and Policies

  • Create a policy/procedure outlining all new requirements and who is responsible.
  • Updating bulletin board
  • Monthly meeting (agenda, minutes, list of attendees)
  • Referral process
  • Providing information to residents
  • Meeting with residents and updating ISP
  • Staff training

These requirements have already been added to the annual survey tool for the heightened scrutiny setting locations. Effective October 2026, these questions will be applicable to all SLPs.
